K-Business customer programme rules

1. K-Business customer programme

K-Business is a customer programme (“the Programme”) offered by Kesko Corporation (“the Corporation”) to its business customers. Business customers can join the program and gain access to services and other benefits through the program. The business customers will receive a K-Business Plussa identifier, which can be displayed to use the services and benefits available through the Programme at each time.

The services may include online and mobile services, for example. The benefits may include K-Business Plussa offers from the Corporation’s lines of business or benefits offered by the Corporation’s business partners.

The services and operators offering benefits within the Programme are listed at k-business.fi.

All inquiries, suggestions and comments regarding this Programme and the K-Business customer relationship should be made to the Corporation. The rights to change these rules are reserved.

2. K-Business customer relationship

2.1 Joining

A company or sole proprietor, both of which are referred to in these rules as a “business”, that is permanently engaged in business operations in Finland, can become a K-Business customer (“Business Customer”) . Channels valid for joining at each time can be used to become a Business Customer. The application to join can be filed by a sole proprietor or a representative of a company with the authority to sign.

Upon joining, the Business Customer must provide the requested basic data and accept the K-Business rules. In addition, the Business Customer must appoint a K-Business contact person at the business.

The K-Business customer relationship begins when the Corporation has approved the application to join. The Corporation may also choose not to approve a company’s application to join if the company or its representative has previously misused the benefits or services of the Programme, for example.

2.2 Member identifiers

As a K-Business customer relationship identifier, the Business Customer receives a business-specific identifier, as well as one or more K-Business Plussa identifiers that can be a series of characters or numbers that can be read by a payment terminal, for example. The identifier may be assigned to a particular person or shared, in which case it may be used by more than one person. If the Business Customer already has a Plussa card for the business, they will be automatically linked to the programme and the old Plussa identifier will serve as the K-Business Plussa identifier.

If the Business Customer acquires a K-Business payment instrument offered by a financial institution, a cardholder (“K-Business Cardholder”) is appointed for the payment instrument at the business. The K-Business Plussa identifier is added to the payment instrument. The Business Customer signs a separate agreement for the payment instrument with the financial institution providing it. If a Business Customer has more than one K-Business payment instrument, each of them will have its own K-Business Plussa identifier.

If the Business Customer wants to remove the K-Business Plussa identifier, the Business Customer must contact the K-Business customer service and request the removal of the identifier. If it is a K-Business Plussa identifier linked to a payment instrument, more detailed instructions can be found at k-business.fi.

3. Services and other benefits for K-Business customers

After joining, K-Business customers get access to various services and benefits. The benefits and services available at each time can be used by presenting the K-Business Plussa identifier assigned to the company. No Plussa points are accrued for the Business Customer’s purchases.

The Corporation continuously develops benefits and services aimed at Business Customers. The Corporation reserves the right to change the services and benefits for Business Customers at its sole discretion. Services available at each time are listed at k-business.fi.

The Corporation does not grant any overlapping benefits or discounts for the same goods or services. Benefits or discounts are also not granted retroactively. No targeted or partner benefits or services are granted to the Business Customer for purchases made with a removed K-Business Plussa identifier.

4. Personal data and data on the use of the K-Business Plussa identifier

The data concerning the Business Customer’s K-Business contact person and K-Business cardholders is stored in the K-Business customer register, and the data is processed in accordance with the data protection notice of that register. The data protection notice is available at kesko.fi/k-businesstietosuojaseloste.

The Business Customer is obligated to provide the K-Business customer register’s data protection notice to the appointed K-Business cardholders for information.

The Corporation may use data generated by the use of the K-Business Plussa identifiers belonging to the Business Customer, including product-specific purchase data, and process them for the marketing purposes of partners involved in the K-Business cooperation in accordance with the Data Protection Regulation. The Corporation stores the data generated by the use of the K-Business Plussa identifiers for the duration of the K-Business customer relationship.

5. End of the customer relationship

The K-Business customer relationship ends when the Business Customer notifies the Corporation of this.

If the Corporation considers for a justified reason that the K-Business customer does not comply with these rules or otherwise no longer fulfils the conditions for the K-Business customer relationship, the Corporation has the right to terminate the K-Business customer relationship by sending the K-Business customer a notice of termination. The K-Business customer relationship ends one (1) month after the notice of termination.

The Corporation has the right to terminate the Programme by notifying the K-Business customer of this at least three (3) months before the termination of the Programme.

6. Other terms and conditions

The K-Business customer must notify the Corporation of the postal address of their business in Finland, including without delay any changes to it. The K-Business customer must notify the Corporation without delay of the discontinuation of business activities or a name change. The Corporation only sends customer mail within Finland.

The Corporation has the right to change the rules of the Programme by notifying the K-Business customer of this. Rule changes enter into force at the earliest one (1) month after the K-Business customer has been informed of the change. If the Business Customer continues to use the K-Business Plussa identifier after the rule change has entered into force, it is deemed to have accepted the changed terms and conditions.

A notification or dispatch by the Corporation in accordance with these rules is deemed to have been duly made when the Corporation has sent it to the postal or email address last reported to the Corporation by the K-Business customer. The K-Business customer is considered to have received the notification by the seventh day after the notification was sent.

These rules are governed by Finnish law with the exception of the connecting factor rules. Disputes arising from the rules shall be finally settled by arbitration in Helsinki in accordance with the arbitration rules of the Finland Chamber of Commerce. The language of the arbitration shall be Finnish. The arbitration proceedings, including the arbitration documents and the arbitration award, shall be secret unless otherwise agreed
